Kenai man scuffles with police

A Kenai man has been charged with multiple counts of assault on a police officer. 

Brian Hoge, 48, allegedly grabbed an officer by the neck after he was pulled over for a DUI in October of last year. 

Police report Hoge was agitated when pulled over at 12:41 a.m., Oct. 29, 2011 off of Tinker Lane and Kaknu Way. He allegedly had an odor of alcohol coming from his breath, thick speech and bloodshot watery eyes. 

Hoge initially refused to step out of his vehicle to perform a field sobriety test. While performing the test he was uncooperative, according to court records. 

As Officer Morgan Ezell attempted to place the alleged offender under arrest, Hoge pulled his arm away. Officer Trevor Miller attempted to aid Ezell but was grabbed around the neck and pulled to Hoge’s chest, according to court records. 

Hoge was pepper sprayed and shot twice with a Taser before releasing the officer, who complained of pain in his neck, back, shoulders, jaw and teeth, according to court records. 

Hoge has been charged with two counts of second-degree assault, two counts of third-degree assault, fourth degree assault, refusing to submit a chemical test, DUI and resisting arrest. 

All of the second- and third-degree assault charges are felonies, and three of those charges are specified as intent to cause harm with a dangerous weapon. According to Alaska law, when a person places their hands on another person’s neck the hands are classified as a weapon. 

Hoge remains at Wildwood Correctional Center. Bail has been set at $10,000.

Trial is set for March 5 at the Kenai Courthouse.

Another Stupid Law

Now that you know not to put your hands on anyone's neck, you may as well just grab what ever is handy. Nothing lost, the charge is the same.

Very timely

This happened in October.Why wait over 3 months to charge this guy or is the reporting that slow?

What?

Hands can easily choke somebody by the neck and choking a person is classified as a lethal maneuver, that's why they're classified as weapons when used to strangle somebody.

Regular fighting doesn't involve entrapment of vital areas and doesn't warrant that kind of felony.

dismissals

Anyone read todays paper? Every single court case was dismissed. EVERY SINGLE ONE!!! There had to be over 20 of them.

This is a huge injustice to our community and law enforcement. What steps can we as citizens take to put a stop to all of these dismissals?

NO VACANCY, No more Room at the Inn, Full Up, No More Space for Inmates. Shipping Convicts off to Arizona cuz there is no more room for them in Alaska
That just may be Why the Judges are Dismissing Local Criminals ?

Meanwhile back at the Ranch, the Local Brand Newly Constructed Prison in "The Valley" sits empty & Vacant cuz Our Brillant Alaskan Management forgot to included the Water & Septic System for the Multi Million Dollar Prison ! DUH !
