Unions file unfair labor charge

The Kenai Peninsula Education Association and the Kenai Peninsula Education Support Association filed an Unfair Labor Practices claim against the Kenai Peninsula Borough School District on Tuesday.

The unions filed the complaint with the Alaska Labor Relations Agency because the district released confidential information during the mediation for contract negotiations on its website, according to a KPEA/KPESA press release.

"Basically the dispute is they were bound by the same agreement we were in mediation, that anything coming out of mediation would not be discussed unless it had resulted in an actual proposal," KPEA President LaDawn Druce said.

KPBSD Assistant Superintendent Sean Dusek said the district has not had a chance to look over the claim as of Wednesday.

"It's premature for us to make any comments right now," Dusek said. "We're just totally focused on setting up a meeting with the associations to continue negotiations."

The ALRA, based in Anchorage, will be sending a letter to the district and the associations within the next three days acknowledging the charge was filed, ALRA Hearing Officer Jean Ward said. The letter will also ask for a response from the district within two weeks, she said.

"Then we investigate the matter to see if there's probable cause to support the charge," Ward said. "If there is then I work with the parties informally to see if there's a way it can be resolved."If that happens, she said, then it goes away, but if an informal resolution doesn't work, and if there is probable cause, the issue goes to a hearing in front of a three-member panel of ALRA board members.

"If I investigate it and I don't find probable cause, I issue a notice of preliminary finding after investigation which can be appealed by a three-member panel of our board," Ward said.
