Man arraigned for kidnapping, assault with a rifle

Tuesday at the Kenai Courthouse, a man wanted by troopers for four months prior to his arrest on Saturday pleaded not guilty to multiple charges, which include kidnapping and assault.

Superior Court Judge Carl Bauman levied a combined bail amount of $150,000, noting the seriousness of Bret Herrick’s offenses as reason for the large payment.

A Kenai grand jury indicted the 53-year-old in September on charges of kidnapping, first-degree burglary, four counts of third-degree assault and third-degree theft.

On Aug. 3, the defendant allegedly kidnapped a Homer man at gunpoint, forced the man into his truck and drove to a local bank, where he forced the man to withdraw money from an ATM.

The man escaped by throwing money into Herrick’s face.

Herrick allegedly entered the man’s East Skyline Drive home brandishing an AR-15 semiautomatic assault rifle with a large capacity drum magazine. He had been on the loose since the August incident.

Troopers weighed the public’s safety, cautioning Kenai Peninsula residents that Herrick was armed and dangerous.

During Tuesday’s arraignment, District Attorney Scot Leaders argued a substantial bail amount was necessary to protect the public. Also, Herrick is a flight risk, Leaders said.

The state noted a prior offense involving a weapon, but said the defendant had no felonies.

Public Defender William Taylor asked the court to set bail at a reasonable amount and argued the added requirement of a third-party custodian should reduce the bail’s amount.

There were three alleged victims of Herrick’s offenses, said Bauman, and a grand jury decided it had heard sufficient evidence to charge him. A larger bail was appropriate, he said.

A friend of Herrick’s who declined to give his name inquired how he could find a bail bondsman on the Peninsula, but the court offered little advice.

The court scheduled an omnibus hearing for Jan. 25 at the Kenai Courthouse. Herrick’s trial was scheduled for the week of Feb. 25 in Homer.

Troopers on Friday arrested Herrick after a chance encounter at the Anchor Point Grocery Store. Trooper Daniel Brom stopped to get a snack at the grocery store on the Old Sterling Highway at 10:24 p.m. Brom noticed a bald man sitting in the passenger seat of the truck next to his patrol car. The man attempted to hide his face, troopers reported.

The trooper identified Herrick, who left the truck and entered an adjacent liquor store. He called for backup, and two troopers arrested Herrick following a brief scuffle.

Herrick allegedly raised his fists at the troopers and resisted being handcuffed. When troopers pinned Herrick on the ground with his hands beneath him, Brom attempted to pull Herrick’s hands out; Herrick said, “You’re going to have to work for them.”

Troopers found a knife, bullets and two handgun magazines on Herrick, they reported.

I remember now!

I remember now, we can TRUST police and military for all our needs.
What part of dirty cops or military personell don't you seem to understand or acknowledge as the world turns and daily news reveals these corrupt EVIL people that are supposed to protect us?
Their Magizines, not clips, and i seen a 50 round xs x-10 .308 magizine on sale on craigs list for $200 on sunday, with the words of buy it while it's legal and available. GOOD ADVICE!
As i stated above the Anchorage cop that used his weapon of choice to rape all those women while he was out protecting us and them is allowed to carry assult weapons and he is not the miniority in this EVIL war against fellow humans. But you think this type is ok because he is a policeman? Many military have also gone off the EVIL cliff, and you think we should also trust all of them? AIN'T GONNA HAPPEN DREAMERS. I TRUST in God and the wisdom and tools he gave me to fight this EVIL at EVERY level and the understanding that NO GREATER LOVE HAS ANY MAN THAN TO LAY DOWN HIS LIFE FOR A FRIEND. WHO are my Friends? EVERY HUMAN, no matter race, color, creed, gender religion or what ever class one wants to place people into. When EVIL rises up and wants to kill or harm my fellow mankind with bodyly harm or death then i think we must all step up and fight this EVIL. I might not agree with your free will choices for life or religion, but i ain't gonna kill you for those beliefs either unless you attack me or others wanting to inforce your will on every one or else.
EVIL is every where and can stike any time by any person plain and simple, it's not the guns thats the trouble, it's EVIL PEOPLE. My job is to love people no matter who and allow God the responcibility of judging their souls, i might not like their ethics or moral standard that differ from mine or Gods, but he will take of all that at the proper time, not me. My job is to try and show people the right direction for the GOOD OF ALL, in hopes of protecting and saving some from the promised troubles to come at this, the End of the Age, or dispensation of time we are now entering which will culminate after much troubles and global distruction by the EVIL ONE and his followers.
I think we should all be packing EVERY WHERE WE GO and when some EVIL idiot steps out of line then no matter where it's at & starts hurting others they can be delt with by the public, not dependant on police or military for our protection.
They will try to come and take ever weapon there is by force or BS people into turning them in for money along with reporting your neighbors that may have weapons unknown to govt. paper trails showing ownership of weapons.
If you really think EVERY LE or Military personel are Good and want to help & protect you, then you fall into the catagory of an Idiot and know not the Truth or Reality either one.
I promise you if every one packed every where we went, there would be far less troubles and our courts and prisons would not be so full. If the GOVT. really cared about the citizens then they would certainly not promote laws that allow any types of sex or drugs or other health related issues to become laws which are ment to destroy social society, not promote it for the good of society.
The killings of these kids in CT or CO or any where is all about EVIL, not guns. I promise you that it's gonna be a number you can't count when the govt. starts trying to take away our 2nd amendment rights. But i really do think that BO & HIS SHEEPLE will try to do just that in his/their desire to FUNDAMENTALLY CHANGE AMERICA INTO A GOVT. POLICE STATE.

You need to adjust your sights.

Norseman - Your analogy only proves that knee jerk reactions are made. That does not automatically make them appropriate.

You need to review your dates. There was already an assault weapon ban; in place from '94 to '04. The ban was in full-swing when the Columbine shooting happened. It did no good then and it will do no good now.

Gun-haters need to pull their heads out of the sand and finally reailze they are placing blame in the wrong place.

I hope and Pray

daily that it never comes to that where we have to fight for our rights like our forefathers did against evil govts.
What i see is nuts like this one article and others that the govt., controlers are using to gain or push for the total restriction of weapons of all kinds.

i love my hate

i love my hate here. What I do hate is whackjobs with assault weapons who murder innocent children.

Is an assault ban the one and only answer? NO. But if it stops just one more mass murder of young children, then it will help.

Watching the horrible agony of the parents, grandparents, and the community suffer because another "evil" nut job with an assualt weapon goes berserk requires action. Anything that will lower the risk of one more child being killed will help.

Just because someone may disagree with you don't assume they hate guns. Guns have been a part of my life since I was 10. I carry mine daily.

Very Good Norseman

My question is this. Why is it we have GOOD GUYS with guns or all of us in the form of CIA, FBI, LE, MILITARY all protecting our President? Why can't we have GOOD GUYS protecting our precious childern at school or the Mall or Theater or any where else and not have to wait for them to show up after the 911 calls?
Why can't we all be packing every where, EVERY WHERE, and when these EVIL DEMONS start their desire to kill all of us we step foreward and stop them?
Why do people have to hope and pray that the 911 calls will be answered in time to save any no matter if at home, school, church or shoping mall or movie house, where ever we might be when Evil attacks?
A small Texas school allows every teacher the right to conceal & carry weapons to protect their precious children, why can't we all do like wise?
I promise that if the teachers in CT or CO or else where would have had guns, then the number of deaths would have been smaller. Yes some may have been killed, but, i promise you not as many.
We all need to be qualified to carry and use weapons in this fight against EVIL. More laws restricting the GOOD will only aid the EVIL, causing the problem to escalate with more deaths by EVIL DEMONS.
Stop the madness, it's not the tools, it's the refusal of the GOOD to stand up and fight the BAD. If we allow them to take our guns, then we become more dependant on them to protect us and they can't get-r-done on time to really matter. All the Good guys usually do is waste alot of time and money going in circles trying to figure out what, why, when, who and how these EVIL DEMONS did what they did while Media hypes it out of sight and makes more EVIL want to duplicate and expand for more media glory.
It will also cut down on court costs and expence of keeping these EVIL ONES locked up, or set free on some technocality to kill again.
