Chenault's bill would bar enforcement of new gun laws

JUNEAU — A bill introduced in the Alaska House on Wednesday would make it a misdemeanor for a federal official or agent to try to enforce any new restrictions on gun ownership.

HB69, from House Speaker Mike Chenault, was introduced the same day that President Barack Obama unveiled a package of executive orders and legislative proposals aimed at curbing gun violence.

Obama's proposals, which follow last month's deadly shooting at a Connecticut school, include background checks for all gun sales and a ban on assault weapons and high-capacity ammunition magazines. His 23 executive orders touched on such things as gun safety, background checks and mental health.

Chenault, in a news release, said work on his bill began before Obama's announcement Wednesday.

"Tragedy is not a license for federal encroachment on constitutionally protected freedoms," he said. "We can all agree that what happened in Newtown, Conn., was an absolute tragedy. But what we fundamentally disagree on is how you meet the challenge it presented.

"The president is using it to further his liberal agenda to try and disarm and disenfranchise law-abiding Americans from their enshrined Second Amendment rights," he said. "No one should be comfortable with that, regardless of where you sit on the issue."

His bill would deem unenforceable federal laws, orders, rules or regulations enacted or effective on or after the effective date of his bill that seek to ban or restrict ownership of a semi-automatic firearm or magazine, or that require a firearm, magazine or firearm accessory be registered. The bill says any federal official, agent or employee who tries to enforce any such provisions is guilty of a Class B misdemeanor.

Chenault, R-Nikiski, said he is building on a measure that passed the state Legislature in 2010, that exempted personal firearms, accessories or ammunition manufactured in Alaska from federal law or regulation, including registration.

HB69 has an immediate effective date, but Chenault plans to work with a House committee to make the effective date retroactive to Jan. 1, should the bill pass.

The measure had at least 11 Republican co-sponsors by late Wednesday afternoon.

Praise the LORD for these ones and others that are willing to stand against Evils desire to reinslave us all by a Tyrannical despot who would totally remove our constitution which is the only thing standing in their hopes of fundamental changes for the Global society. As Obama called us mean Americans that cling to our bibles & guns, well it's beacuse of Presidents like him that our forefathers and God warned us would come after each is why we are what we are.
Of course our Guns & Bibles are also another reason it has not been attempted in the past, this take over, see Japans Emperiors statement to this fact when Japan attacked Hawaii instead of the mainland America. A gun behind ever blade of grass in America, i think is what he said. He was right.
I truly believe that our rights shall be further challanged by turning over control of arms to the UN any day now and their Blue Hats will do what America's Truthful Honest OATH Takers will not, which is try and take our arms from us.
They will keep trying to slip in from many angles to get-r-done their desire to remove our constitution and will succeed if we are not ever vigilant against their attacks and use of love or fear from EMOTIONS to sway the many.
A BIG Thank You to all Alasdka State Reps who support this HB69 and GET-R-DONE SOON i pray.
I would make the offence against fellow Americans more than a misdemeanor though, but it's a start and thanks for that.

drjofak: question. Does the Supremacy Clause take precedence over the 2nd Amendment? Does it have more validity than the 10th Amendment?
Before you insult Mike, consider that at least he is doing SOMETHING other than sitting there like a kicked dog waiting to be kicked again.
A number of other states have already taken this same action. Are they ALL stupid and pandering?
Do YOU know something they all have missed? And when you accuse someone of being "stupid and pandering", what about the use of Executive Orders to bypass Congress, with the full knowledge that such actions themselves will not pass legal muster? Is THAT not stupid and pandering?
Perhaps Mikes action will result in legal action, at least he is doing something to prevent that arrogant, Pretender from trying to get away with actions more like a DICTATOR or KING than OUR EMPLOYEE.
I am proud that Mike stood up and took the first step to send a loud message to our elected officials in Washington, that we will NOT sit here and wait for any further useless laws or regulations that will have NO MEANING because the 'bad guys' will never obey them and the law-abiding citizens don't need them.
I would hope that more Alaskans will support HB69 and that it will send a strong message that we have had enough laws and regulations. What part of 'SHALL NOT BE INFRINGED" do they not understand? Are THEY so stupid and pandering that THEY do not understand?

I knew that Mike has an "advanced" high school diploma but didn't realize that it was in the form of having passed the Bar and was an attorney. What a blessing that Mike will use his expertise in law for the "benefit" of the citizenry of Alaska and those on the Peninsula.

Until Milke took up this issue I was going to vote "NO" on the papers guestion asking do you think our state goverment will be productive this year.

So you want to pit local and state law enforcement against federal law enforcement, (of which you are neither), on the basis of laws that don't even exist, and which if they do come to pass in to law will be done by the same democractic process that you're trying to get your idiotic bill passed by? You are a disgrace and an embarressment to us all. Well all except the 11 idiots who think you're on to something good. I just think you're on something.

If we're going to start choosing which laws we're going to abide by and which we're going to ignore I'm sure we all have our own list of those we'd rather not be incumbered by. Mike Chenault is an excellent example of why we have any laws to govern us, let alone gun control laws. You can't simply pick and choose which laws are going to apply to you and which aren't.

What seems to be the main idea here is that folks who want to remove our constitution for the advancement of a Global Citizenry will try to bypass it's rights for Americans protection against governments and people that would RE-INSLAVE US ALL. It's OK for them to pander and do everything they can to re-move our rights, but, bygod we had better not try the very same tactics or it's an act of violence against the Govt.. REALLY?
As for the shooters AR-15 being in the car if this was actually a TEST as alot of evidence which is now surfacing after the fact which shows that indeed it may have been a staged event for the purpose of instilling fear and crys for the need to restrict guns. When considers that many Dems said they had been working on such a time as this for tighter gun control and then it happens does make one wonder.

The thing is that self seeking people have ALWAYS USED EMOTIONS to get people to react and do their bidding for one reason or another. DON'T BE DUPED!

There were no Executive Orders

What the President did was hold a press conference and outlined what goals he would like congress to address. No law was made, nothing has changed, but a dialogue was started and many ill-informed frothing people took this as their time to spew their views from every corner of ignorance. Congress would still have to act to change and implement many of proposed Executive Actions, which on their own have no force of law. Actions 20 through 23 are by far the most critical. Special funding should be allotted for "Truthers" that think the government killed the kids, or that no one was killed.
Presidential Actions
1. Issue a Presidential Memorandum to require federal agencies to make relevant data available to the federal background check system.

2. Address unnecessary legal barriers, particularly relating to the Health Insurance Portability and Accountability Act, that may prevent states from making information available to the background check system.

3. Improve incentives for states to share information with the background check system.

4. Direct the Attorney General to review categories of individuals prohibited from having a gun to make sure dangerous people are not slipping through the cracks.

5. Propose rulemaking to give law enforcement the ability to run a full background check on an individual before returning a seized gun.

6. Publish a letter from ATF to federally licensed gun dealers providing guidance on how to run background checks for private sellers.

7. Launch a national safe and responsible gun ownership campaign.

8. Review safety standards for gun locks and gun safes (Consumer Product Safety Commission).

9. Issue a Presidential Memorandum to require federal law enforcement to trace guns recovered in criminal investigations.

10. Release a DOJ report analyzing information on lost and stolen guns and make it widely available to law enforcement.

11. Nominate an ATF director.

12. Provide law enforcement, first responders, and school officials with proper training for active shooter situations.

13. Maximize enforcement efforts to prevent gun violence and prosecute gun crime.

14. Issue a Presidential Memorandum directing the Centers for Disease Control to research the causes and prevention of gun violence.

15. Direct the Attorney General to issue a report on the availability and most effective use of new gun safety technologies and challenge the private sector to develop innovative technologies

16. Clarify that the Affordable Care Act does not prohibit doctors asking their patients about guns in their homes.

17. Release a letter to health care providers clarifying that no federal law prohibits them from reporting threats of violence to law enforcement authorities.

18. Provide incentives for schools to hire school resource officers.

19. Develop model emergency response plans for schools, houses of worship and institutions of higher education.

20. Release a letter to state health officials clarifying the scope of mental health services that Medicaid plans must cover.

21. Finalize regulations clarifying essential health benefits and parity requirements within ACA exchanges.

22. Commit to finalizing mental health parity regulations.

23. Launch a national dialogue led by Secretaries Sebelius and Duncan on mental health.

The 2nd Amendment has no option to be repealed via populous vote or Liberal Court Appopintees. If it bothers you that the Bill of Rights is proclaimed as the most important document this side of the Magna Carta why? The current powers that control Washington have failed repeatedly to to turn the direction of our economy from the fiscal cliff. The will of the people to have a secure economic future has been wasted and scorned via over spending and pork barrel politics. If the powers that are in control of fiscal policy can't steer this great land of plenty away from the certain peril of the fiscal cliff why should I trust them with the 2nd?

First of all my patriotism and loyalty is to the US of A. Then secondly to my state. When I served in the Army, I served for the entire country, not for one state who may not like what the commander in chief implements as executive orders.

United we Stand and divided we fall holds very true today. If any single state thinks our government is so oppressive, perhaps they ought to go to Syria for a little while.

So bye what right do certain States think it is proper to stop out of state duck hunters traveling through say Mass. going to a once in a lifetime Goose hunt in Maine. Arrest them right on the interstate and haul them to jail, impound their truck and boat. Neglect the valuable trained hunting dogs to the point they died of heat exposure. Treat them abusively and call it resisiting an officer when they merely protested that in 60 miles they will be out of Mass. Two days in jail for 3 hunters and huge personal losses because some jerk wanted to show his authority. That is the type of BS rules that gun control leads too.
As a citizen for some state to say you can't even travel through my state with your goose guns is Draconian. Closing I-95 to traffic of Goose hunters is not the purpose of Gun Control just the outcome when unchecked. So Yea I want to challenge any and all of your fairytail ideas that disarming law abiding folks is the answer to any problem we are facing.

The government is corrupt; local, state and federal, it's all corrupt. Most of it is a pony show catered to retain voters for next election in order to stay in power as long as possible. Raoulduke - I guess I should have phrased it differently then. Does it matter why? This is still a childish way of looking at it. So there was no complaining when the last three administrations were in office so there is no point complaining now? You are applying the party label. I think it is you that needs to get over it. The country is spinning around the drain both economically and morally. I believe the combination of government spending sprees leaving the US in insurmountable debt and the increasing population that doesn't want to take responsibility for themselves puts this country a lot closer to the drain than it has ever been.

The current President wants to make both these problems worse and the current Congress doesn't want to fix them because they are the direct tools used for reelection.

Now, to get back on topic - States Rights. It is funny that you rebuke the Senator's bill because the State can't override Federal law and then in your very next post remind BRD that State's have rights and can do what they want. Please make up your mind, lest you start making the flipflop sound when you type.

Alaska is (hopefully) still a bastion of Conservatives. People who are willing to accept responsibility for themselves and have a drive to make their lives better. We, as Alaskans, have no hope of affecting change in the Federal Government. Our collective voice is simply too small. Which is why State's Rights are so very important and why the Senator's bill, be it hotair or not, is a good thing to see in our State government. We need people willing to take a stand against the stupidity in the Federal Government, whether it is currently legal or not. We can only hope to stand with the other states that are still bastions of Conservatives in this discussion of true common sense freedom.

If you are not happy, or do not agree, with a majority of the conservative viewpoints then you will hopefully have a neverending battle within your community here.

Massachusetts did not pass any law that would have violated any federal law . Alaska is trying to bar federal authorities from performing their duty.A completely different scenario.
Alaska for being a Conservative Bastion .Receives more Federal aid,and monies than any other state,or states combined.I would like to know What Conservative principle is Gov.Parnell using.When giving huge tax breaks to oil companies for very little,or nothing in return?

It was legal by federal law, but not legal under state law. Seems pretty close to me, but from the direction you are looking at it, I can see how you feel it is different.

First, I would agree that Alaska receives a larger share "per capita" than most states, but not more in total that every other state.

And when referring to the conservative bastion of Alaska, I was speaking of the people here, not the politicians. I would agree that our state government is just as fraught with misconduct as the federal government is.

Where were you from 2000-2008?invading a country to remove a head of state is a violation of International Law.Allowing torture is a violation of the Geneva Convention.Not to mention the civil liberties that were abused through the Patriot Act.Which had absolutely nothing to do with Patriotism,or the FREE speech zones.Which had nothing to do with FREE speech.Yes! This is true.I can not tell you. Why Pelosi ,or Reid did,or did not do certain things.I am just not that gifted.

Geneva Convention.

I believe we were attacked by a group of terrorists who were not there to sign the Geneva Convention so how can they claim that right of protection. As for invading a country who was known to harbor terrorist tough titty.Maybe they had not harbored this particular group, which some believe, they still they still were guilty. I agree you are not that gifted.

It matters not whether the terrorist signed the Geneva Convention,or not.WE DID! We had a president.Who said 'BRING IT ON' to the terrorist.Which I found to be a very stupid remark.Just imagine.What was racing through the Infantryman's mind. When they heard the remark.Then Bush publicly agreed to allow our Servicemen,and women to stoop to the level of the terrorist.No matter what.This country signed the Geneva Convention.,and it BANS torture.We should not treat this document as if it were one of the treaties .We had made with the native Americans. Bush,and his advisers after the fact.Stated there was NO WMD,and no connection to a terrorist group.That appeared to happen after the U.S.A invaded for no other reason than to remove one of our own lackey's.There were NO IRAQI's involved in 9/11.So! How can they be guilty?Would you like to be punished for something.You did not do? You need to lay off of Beck,Limbaugh,and Fox.You may get the rest of the story if you do.Investigation's showed.Iraq had NO involvement. Saudi Arabians,and Yemeni were the majority of the crew that did do the bad deed.The only flight out of the U.S. that day was the Bin Laden family.Could that be why we invaded the WRONG country.Remember! Unfortunately it is all about the OIL.What do you expect from a country that has displayed a great many characteristic's of a FASCIST state for a long time now.Well! We agree on something. Take your majority and stuff

It doesn't matter in these great United States that you amass a majority, even if your ahead by 8,10, or even 13% you still don't get to squash the rights of your fellow citizens. Isn't that just lovely? For ANY political party to think because they have won a few elections now we can rewrite the play book is just plain old Democratic trash. Just like Thomas Jefferson said, "There you have a Republic, hope you can keep it". Well I have noticed a certain "mentality" for lack of another discription, exihibited by supporters of the gun controlling left.
Every dictator in the world that succeeded in overthrowing any populous government immediately imposed near universal gun control. In 1826 John Adams said," There are two ways of enslaving a nation. One is by sword, the other is by debt." Well if there is somebody out there who feels our huge debt needs increased, "You are insane!"
When I see elected officials shopping for social issues that endear voters, like cherries on a tree, picking the ones that will get them elected I soon recognize a pattern. Our current political system panders to any social Massiah willing to pick that fruit. You know the old universal appeal off everybodies everything right here for free just vote for me crowd. Now the media has pumped us up for gun control, like flexing their muscle; exihibiting huge control over public opinion. Just continued barrage of bubble headed ideas to wash your brain clean of any decending thoughts. Hell we have a majority what are we waiting for. All these unruly citizens don't have any rights do they? They are a minority don't they know all they have is up for grabs because we WON.
