Judge refuses to dismiss Allvest suit against Delta

FAIRBANKS (AP) -- A Superior Court judge has refused to dismiss a breach of contract lawsuit filed against the city of Delta Junction by Allvest, the company that wanted to run a private prison at Fort Greely.

Delta Junction's lawyer, George Lyle, argued Thursday that the contract between Allvest and the city wasn't legal.

But Superior Court Judge Charles Pengilly ruled the lawsuit should go forward.

The lawsuit is set for trial April 23. But the case may be delayed to await a bill in the Legislature that would authorize a private prison in Kenai and eliminate the statute authorizing the Delta Junction facility.
