Judge dismisses lawsuit against Native corporation

Posted: Thursday, May 01, 2003

ANCHORAGE (AP) A federal judge has dismissed a lawsuit against a Native corporation in Goodnews.

Goodnews River Lodge sued Kuitsarak Inc. in December because the Native corporation wanted to end a 25-year lease between the two.

U.S. District Judge John Sedwick dismissed the suit Friday, saying there is no federal jurisdiction for the case. The complaint is based on state law, and Sedwick said U.S. District Court is not the right place to bring the lawsuit.

According to court documents, Kuitsarak told the lodge to vacate its buildings on Goodnews River. The owners of the sportfishing lodge said they made regular payments and want to continue operating.

The complaint says the lodge lost about $50,000 from customers canceling reservations or failing to sign up because of the dispute.
