FAIRBANKS (AP) -- A Galena man on trial on charges of first-and second-degree sexual assault was acquitted of the first charge Friday in Superior Court.
The jury was unable to reach a decision on the second charge against Glen Duncan, 33.
The trial was Duncan's second on the charges. A trial in January resulted in a hung jury on both counts.
The charges against Duncan relate to an incident that took place July 15 in Galena, 275 miles west of Fairbanks on the Yukon River. Duncan was charged with sexually assaulting a woman who was incapacitated or unaware that a sexual act was being committed.
Prosecutor Teresa Foster is expected to announce next week whether the state will seek a third trial.
Duncan is not in custody.
