Kenai man indicted on sexual assault

A Kenai man was indicted last week with eight sexual assault charges relating to an alleged Nov. 29 incident when he was discovered having sex with a 32-year-old woman with Down syndrome.

Nicasio Castro III, 53, was indicted in district court with two first-degree sexual assault charges, four second-degree sexual assault charges and two third-degree sexual assault charges.

The charges state Castro "engaged in sexual penetration with MC, a person who the offender knew was mentally incapable," according to indictment records.

Castro is being held in the Wildwood Pretrial Facility and is scheduled for an arraignment in Superior court this afternoon.

The woman is said to have the mental capacity of a 3-year-old girl, according to Alaska State Trooper investigator Toma Caldarea's affidavit.

Bail is set at $25,000.
