The following dismissal was recently handed down in Kenai District Court:

A charge against Herbert Virgil Averett, 48, of Soldotna, of driving while license canceled, revoked or suspended with a previous conviction was dismissed. Date of the charge was Feb. 6.

The following judgments were recently handed down in Kenai District Court:

Herbert Virgil Averett, 48, of Soldotna, pleaded guilty to driving while license canceled, revoked or suspended with a previous conviction, committed Sept. 3. He was sentenced to 10 days in jail with 10 days suspended, fined $500 with $500 suspended, a $100 court surcharge and a $150 jail surcharge with $100 suspended, ordered not to drive unless properly licensed, and placed on probation for 12 months.

Yutana Mercedes Brooks, 26, of Onalaska, Washington, pleaded guilty to an amended charge of fourth-degree theft, committed Aug. 12. She was sentenced to 90 days in jail with 90 days suspended, fined $500, a $100 court surcharge and a $150 jail surcharge with $100 suspended ordered to have no contact with victims or their property, ordered to pay $15,500 restitution immediately, and placed on probation for 24 months. All other charges in this case were dismissed.

Priscilla Jean Chya, 36, of Soldotna, pleaded guilty to driving while license canceled, revoked or suspended with a previous conviction, committed Aug. 15. She was sentenced to 120 days in jail with 120 days suspended, fined $500 with $500 suspended, a $100 court surcharge and a $100 jail surcharge with $100 suspended, ordered not to driving unless validly licensed, and placed on probation for 12 months.

Thera Lynn Michelle Enderle, 36, of Kasilof, pleaded guilty to one count an amended charge of fourth-degree assault (causing fear of injury) and one count of reckless driving, committed July 24, 2020. On count one, she was sentenced to 330 days in jail with all but time served suspended, fined $2,000 with $2,000 suspended, a $100 court surcharge and a $150 jail surcharge with $100 suspended, ordered to have no contact with victim, ordered to complete anger management and follow all recommendations, forfeited items seized, and was placed on probation for 36 months. On count two, she was sentenced to 30 days in jail with 30 days suspended, fined $1,000 with $500 suspended, had her license revoked for 30 days, and was placed on probation for 36 months. All conditions and orders are concurrent with those in count one.

Chandra Ladawn Jicha, 32, of Sterling, pleaded guilty to one count of violating custodian’s duty regarding a felony and one count of fifth-degree misconduct involving a controlled substance, committed July 5, 2020, and one count of violating conditions of release for a misdemeanor, committed Nov. 3, 2020. On the count of violating a custodian’s duty, she was sentenced to 30 days in jail with 30 days suspended, fined $1,000 with $1,000 suspended, a $100 court surcharge and a $150 jail surcharge with $100 suspended, ordered to complete an Alcohol Safety Action Program evaluation and follow all recommendations, forfeited all items seized, and was placed on probation for 24 months. On count two, she was sentenced to 30 days in jail with 30 days suspended, fined $1,000 with $1,000 suspended, forfeited all items seized, and placed on probation for 24 months. On the count of violating conditions of release, she was sentenced to 30 days in jail with all but time served suspended, fined $1,000 with $1,000 suspended, ordered to contact the Alcohol Safety Action Program for an assessment and follow all recommendations, forfeited all items seized, and was placed on probation for 24 months. All other charges in this case were dismissed.

William Shane Kindt, 48, of Homer, pleaded guilty to driving under the influence, committed May 20, 2017. He was sentenced to 30 days in jail or on electronic monitoring, fined $3,000, a $75 court surcharge, a $150 jail surcharge with $100 suspended and $1,467 cost of imprisonment, ordered to complete Alcohol Safety Action Program treatment, had his license revoked for one year, and forfeited all items seized. All other charges in this case were dismissed.

William Shane Kindt, 48, of Homer, pleaded guilty to resisting or interfering with arrest (by force), committed June 14, 2017. He was sentenced to one year in jail with one year suspended, fined $5,000 with $5,000 suspended, a $50 court surcharge and a $150 jail surcharge with $100 suspended, forfeited all items seized, and was placed on probation for one year. All other charges in this case were dismissed.

Toni Michelle Murphy, 36, of Largo, Florida, pleaded guilty to fourth-degree assault (recklessly injure), committed Feb. 20, 2020. He was sentenced to 360 days in jail with all but time served suspended, fined a $100 court surcharge and a $150 jail surcharge with $100 suspended, ordered to have no contact with victim unless approved by the Office of Child Services, ordered not to consume or buy alcohol for 36 months, ordered to complete a substance/alcohol abuse assessment, follow all recommendations, and submit quarterly compliance reports to the Kenai District Attorney’s Office, and was placed on probation for 36 months.

Toni M. Maier, 36, of Largo, Florida, pleaded guilty to violating conditions of release for a misdemeanor, committed July 9, 2020. She was sentenced to 60 days in jail with 60 days suspended, fined a $100 court surcharge and a $150 jail surcharge with $100 suspended, ordered to have no contact with victim unless approved by the Office of Child Services, ordered not to consume or buy alcohol for 36 months, ordered to complete a substance/alcohol abuse assessment and follow all recommendations, and placed on probation for 36 months.

Toni Michelle Maier, 36, of Soldotna, pleaded guilty to one count of driving under the influence and one count of violating conditions of release for a misdemeanor, committed Jan. 27. On count one, she was sentenced to 150 days in jail with 130 days suspended, fined $4,000 with $1,000 suspended, a $150 court surcharge, a $150 jail surcharge with $100 suspended and $1,467 cost of imprisonment, ordered to complete Alcohol Safety Action Program treatment, had her license revoked for one year, ordered ignition interlock for 12 months, ordered not to possess, consume or buy alcohol for three years, and placed on probation for 36 months. On count two, she was sentenced to 60 days in jail with 60 days suspended, ordered to have no contact with victim unless approved by the Office of Child Services, ordered not to consume or buy alcohol for 36 months, ordered to complete a substance/alcohol abuse assessment and follow all recommendations, and placed on probation for 36 months.

She was sentenced to 60 days in jail with 60 days suspended, fined a $100 court surcharge and a $150 jail surcharge with $100 suspended, ordered to have no contact with victim unless approved by the Office of Child Services, ordered not to consume or buy alcohol for 36 months, ordered to complete a substance/alcohol abuse assessment and follow all recommendations, and was placed on probation for 36 months.

Mira Ina Nash, 23, of Chevak, pleaded guilty to driving under the influence, committed Jan. 16. She was sentenced to 120 days in jail with 117 days suspended, fined $2,000 with $500 suspended, a $150 court surcharge, a $150 jail surcharge with $100 suspended and $330 cost of imprisonment, ordered to complete Alcohol Safety Action Program treatment, had her license revoked for 90 days, ordered ignition interlock for six months, ordered not to possess, consume or buy alcohol for two years, ordered to have no controlled substances without a valid prescription from a license provider, taken as prescribed, and maintained in their original containers, and was placed on probation for 24 months. All other charges in this case were dismissed.

Mira Ina Nash, 23, of Chevak, pleaded guilty to one count of an amended charge of second-degree harassment (offensive physical contact) and one count of violating conditions of release for a misdemeanor, committed Jan. 31. On count one, she was sentenced to 90 days in jail with 85 days suspended, fined a $100 court surcharge and a $150 jail surcharge with $100 suspended, ordered to have no contact with victim, ordered not to consume or buy alcohol for 24 months, ordered not to have controlled substances without a valid prescription from a licensed provider, taken as prescribed, and maintained in their original containers, and was placed on probation for 24 months. Count two was a conviction of record only. All other charges in this case were dismissed.

Mira Ina Nash, 23, of Chevak, pleaded guilty to violating conditions of release for a misdemeanor, committed Jan, 31. She admitted facts sufficient to support the plea. This is a conviction of record only.

Billy Clyde Pickens, 61, of Anchorage, pleaded guilty to operating a motor rated at greater than 50 horsepower in restricted areas (Kenai River Special Management Area), committed July 24. He was fined $1,000 with $500 suspended and a $100 court surcharge and placed on probation for 12 months.

Tommy Raymond, Sr., 55, of Anchorage, pleaded guilty to driving under the influence, committed July 4. He was sentenced to 90 days in jail with 87 days suspended, fined $2,000 with $500 suspended, a $150 court surcharge, a $150 jail surcharge with $100 suspended and $330 cost of imprisonment, ordered to complete Alcohol Safety Action Program treatment, had his license revoked for 90 days, ordered ignition interlock for six months, ordered not to possess, consume or buy alcohol for one year, and placed on probation for 12 months.

James William Scaggs, 25, of Nikiski, pleaded guilty to driving under the influence, committed Aug. 28. He was sentenced to 90 days in jail with 87 days suspended, fined $2,000 with $500 suspended, a $150 court surcharge, a $150 jail surcharge with $100 suspended and $330 cost of imprisonment, ordered to complete Alcohol Safety Action Program treatment, had his license revoked for 90 days, ordered ignition interlock for six months, and placed on probation for 12 months.

Araisa Silva, 20, of Soldotna, pleaded guilty to second-degree criminal trespass (upon premises), committed Mar. 3. She was sentenced to 10 days in jail with 10 days suspended, fined a $100 court surcharge and a $150 jail surcharge with $100 suspended, ordered to have no contact with Soldotna Safeway, ordered to complete a mental health assessment, medication management and one-on-one counseling and follow all recommendations, and was placed on probation for 36 months.

Araisa Silva, 20, of Soldotna, pleaded guilty to violating conditions of release for a misdemeanor, committed Mar. 5. She was sentenced to 10 days in jail with 10 days suspended, fined a $100 court surcharge and a $150 jail surcharge with $100 suspended, ordered to have no contact with Soldotna Safeway, ordered to complete a mental health assessment, medication management and one-on-one mental health therapy, and placed on probation for 36 months. Daniel Andrew Spiers, 34, of Kenai, pleaded guilty to fourth-degree assault (recklessly injure), committed Aug. 19. He was sentenced to 180 days in jail with 170 days suspended, fined a $100 court surcharge and a $150 jail surcharge with $100 suspended, ordered to have no contact with victim unless requested in writing with a copy provided to the District Attorney’s Office, ordered to complete Alcohol Safety Action Program treatment, and placed on probation for 60 months. All other charges in this case were dismissed.

Daniel Andrew Spiers, 34, of Kenai, pleaded guilty to one count of fifth-degree misconduct involving a controlled substance, committed Aug. 29. He was sentenced to 180 days in jail with 180 days suspended, fined a $100 court surcharge and a $150 jail surcharge with $100 suspended, ordered to contact the Alcohol Safety Action Program for a substance/alcohol abuse assessment and follow all recommendations, forfeited heroin, morphine, paraphernalia, scales, pipes, tooter straws, tinfoil, drug containers, baggies and butane torches, and was placed on probation for 60 months. All other charges in this case were dismissed.

Bryce Jordan Wiley, 23, of Kasilof, pleaded guilty to an amended charge of fourth-degree assault (causing fear of injury), committed Aug. 31. He was sentenced to 360 days in jail with all but time served suspended, fined a $100 court surcharge and a $150 jail surcharge with $100 suspended, ordered not to consume or buy alcohol for 36 months, ordered to contact the Alcohol Safety Action Program within 10 days of release from custody and follow all recommendations, and was placed on probation for 36 months. All other charges in this case were dismissed.

William Shane Kindt, 48, of Homer, pleaded guilty to first-degree promoting contraband (controlled substance), committed Apr. 17, 2018. He was sentenced to five years in prison with three years suspended, fined a $100 court surcharge and a $200 jail surcharge with $100 suspended, ordered to pay $50 cost of appointed counsel, ordered to have no contact with four specifically named people, forfeited all items seized, ordered, among other conditions of probation, not to use or possess any alcoholic beverages or illegal controlled substances, including synthetic drugs and marijuana, ordered to notify his probation officer within 48 hours of all medication prescriptions and sign a release of information allowing the probation officer to verify the prescription, ordered not to possess, apply for or obtain a medical marijuana card or act as a caregiver while under supervision, ordered to complete a substance abuse evaluation and comply with treatment recommendations, ordered to submit to search directed by a probation officer, with or without probable cause, for the presence of controlled substances, drug paraphernalia and evidence of controlled substance transactions, ordered to provide a list of all social media platforms and online forums to which he subscribes and/or for which he possesses a personal account and all instant messaging, texting or live digital communication programs he uses and/or otherwise possesses on electronic/digital devices and to provide passcodes, passwords and/or any other information needed to access such platforms, forums, programs, and/or devices, ordered to pay restitution to a specifically named person if restitution is sought, and was placed on probation for five years. All other charges in this case were dismissed.

Eugene Howard Olsen, 30, address unknown, pleaded guilty to one felony count of driving under the influence, committed Nov. 6, 2020, and one misdemeanor count of violating condition of release for a felony, committed Aug. 10, 2021. He was sentenced to 20 months in prison with 14 months suspended on count one, credited for time already served and credited for time served on electronic monitoring through VIP (Victim Impact Panel), fined $10,000, a $200 court surcharge and a $200 jail surcharge with $100 suspended, had his license permanently revoked, subject to conditional restoration, is disqualified for life from driving a commercial vehicle, subject to conditional reinstatement, forfeited interest in the 2013 Chevrolet pickup, ordered ignition interlock, for 60 months, ordered, among other conditions of probation, not to use or possess any alcoholic beverages or illegal controlled substances, including synthetic drugs and marijuana, not to reside where alcoholic beverages are present, or enter any business establishment whose primary business is the sale of alcohol, ordered to complete a substance abuse evaluation and comply with treatment recommendations, ordered to submit to search directed by a probation officer, with or without probable cause, for the presence of alcohol, controlled substances and drug paraphernalia, forfeited all items seized, and was placed on probation for five years.
